Myspace Copyright Infringement Counter-Notification

How to File Copyright Infringement Counter-Notification

If your content has been taken down as a result of a notification by a purported copyright owner that such party’s copyright rights are infringed by your content, you may respond by sending us a DMCA counter-notification as follows:

(i)  List the material that was removed by the Myspace administrators, and the location at which the material appeared before it was removed.  Please identify in sufficient detail;
(ii) Provide your name, address, telephone number, e-mail address (if available);
(iii) State that you consent to the jurisdiction of U.S. Federal District Court for the judicial district in which you reside (or Los Angeles, California if your address is outside of the United States);
(iv) State that you will accept service of process from the person who provided notification to us of the alleged infringement or an agent of such person;
(v) State the following: “I swear, under penalty of perjury, that I have a good faith belief that the material identified above was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled”; and
(vi) Your physical or electronic signature (i.e., “/s/ [print name]”).

You may send a copyright infringement counter-notification to:

     Copyright Agent
     Myspace LLC
     8391 Beverly Blvd., #349
     Los Angeles, CA 90048
     copyrightagent@support.myspace.com
     Fax: (310) 734-1748

 Please note that these notifications and counter-notifications are real-world legal notices provided outside of the Myspace environment.  Myspace may provide copies of such notices to the participants in the dispute or third parties, at our discretion and as required by law – Myspace’s Privacy Policy does not limit disclosure of information provided in these notices.
